Terms and Conditions — Buy Off-Season

1. Acceptance of Terms

By accessing, browsing, or otherwise using Buy Off-Season (the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms. These Terms apply to all visitors, users, and others who access the Service.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Buy Off-Season is a contrarian shopping calendar — an editorial site that highlights off-season product picks at their twelve-month price floor on Amazon. The Service provides:

A monthly curated catalog of off-season product picks
A twelve-month contrarian shopping calendar
Field notes and editorial essays about seasonal floor pricing
Outbound affiliate links to Amazon for the products we feature
An optional free account (email or Google Sign-In) for saving picks, syncing watchlists across devices, and tracking which months you've shopped
Floor Pass (currently paused — not accepting subscriptions as of 2026-06-21): an optional paid subscription that, when offered, unlocks price-drop email alerts, synced watchlist, and seasonal pre-alerts — see Section 9 below for the dormant terms

We are not a retailer. We do not sell, ship, fulfill, or refund any product. All purchases happen on Amazon's own website, subject to Amazon's own terms, return policies, and customer service.

3. Pricing accuracy and availability

We make a good-faith effort to surface products at or near their twelve-month price floor. However, Amazon prices change frequently — sometimes hour to hour — and we cannot guarantee that the prices shown on Buy Off-Season exactly match what you'll see at checkout on Amazon.

Always verify the actual price, availability, shipping cost, and any applicable taxes or fees on Amazon before completing your purchase. We are not liable for price discrepancies between what's shown on Buy Off-Season and what's charged by Amazon.

Product illustrations on our site are stylized representations, not photographs of actual packaging. Always confirm the exact product on Amazon's page.

4. Brand names, trademarks, and affiliations

Product names, brand names, trademarks, and logos referenced on this site are the property of their respective owners. We use these names solely to identify the products being featured.

We participate in the Amazon Associates program and earn a small commission on qualifying purchases made through our outbound links. Beyond that affiliate relationship, we are not affiliated with, endorsed by, or sponsored by any brand listed on the site. Our editorial picks are based on the off-season floor price for a category — never on paid placement or commercial relationships with any specific brand.

5. Intellectual property

Except for the third-party brand and product names described in Section 4, all content on Buy Off-Season — including the site design, written copy, original illustrations, the underlying source code, and the curated editorial picks — is owned by Buy Off-Season and protected by copyright, trademark, and other intellectual property laws.

You may:

Browse the site for personal, non-commercial use
Share individual deal or article links with friends, family, or on social media
Print pages for your own reference

You may not:

Copy, redistribute, mirror, or republish substantial portions of the site without our written permission
Scrape or systematically harvest our pricing data, catalog, or images
Use our content to train machine learning models without our written permission
Resell access to our data or recreate the Service in another product

6. Accounts

Creating an account is optional and free. We currently support Google Sign-In; other providers may be added later. By creating or using an account, you agree that:

The account is yours — you authorized the Google sign-in, and the email/profile we receive came from your Google account
You can sign out at any time from the avatar pill in the top-right of any page; signing out clears your session from this device
We may store small bits of preference data (favorited products, last-read issues) tied to your account
Editorial picks are opinions based on observed seasonal pricing patterns, not professional financial, retail, or legal advice

7. User conduct

When using Buy Off-Season, you agree not to:

Scrape, crawl, spider, or otherwise systematically harvest data from the site without our written permission
Use bots, automated scripts, or other tools to access the site at a rate inconsistent with normal human browsing
Attempt to bypass authentication, access controls, or security measures
Probe, test, or breach the security of the Service or any related infrastructure
Submit false or misleading information through any form on the site
Impersonate any person or entity, or misrepresent your affiliation with anyone
Interfere with the normal operation of the site or other users' enjoyment of it
Use the Service in violation of any applicable law, regulation, or third-party right

We reserve the right to investigate violations and take appropriate action, including blocking access, removing content, or referring to law enforcement.

8. Outbound Amazon links

The Service contains outbound affiliate links to Amazon. We provide these links for your convenience and earn a small commission on qualifying purchases through the Amazon Associates program. We have no control over the content, products, prices, shipping, returns, advertising, or privacy practices of Amazon and we expressly disclaim any responsibility for them.

Your interactions with Amazon accessed through Buy Off-Season — including purchases, refunds, customer service, warranty claims, and disputes — are solely between you and Amazon. Buy Off-Season is not a party to those transactions.

9. Floor Pass subscription

Status — Floor Pass is currently paused. We are not accepting new subscriptions or processing charges as of 2026-06-21. The terms below remain on file so users who previously subscribed (if any) have a reference, and so the subscription can resume cleanly when the program restarts. While paused, no signup flow exists and no charges of any kind are made by Buy Off-Season.

Floor Pass is an optional paid subscription. These subscription terms apply only if you choose to subscribe and do not affect your free use of the Service.

9.1 Subscription fee and billing

Floor Pass is offered in two tiers:

Individual — $5.00 USD per month. Single account.
Family — $12.00 USD per month. Up to four (4) separate accounts, all sharing the same billing. The account that subscribes is the "Owner"; they pay the single monthly bill and can invite up to three additional members by email. Each member has their own separate login, watchlist, and alert preferences. Removing a member or canceling the subscription terminates Floor Pass access for the entire family group.

Both tiers are billed in advance on the same day each month using the payment method you provide at signup. We use Stripe (a third-party PCI-compliant payment processor) to handle all card data — we never store your full card number.

Family-plan members other than the Owner do not control the subscription, are not billed, and have no right to continue access if the Owner cancels. The Owner is the sole party to this billing relationship.

9.2 Free trial

New subscribers receive a 7-day free trial. No charge is made during the trial. You may cancel at any time during the trial — including immediately after signing up — and you will not be billed. If you do not cancel before the trial ends, your card will automatically be charged $5.00 and your monthly subscription will begin.

9.3 Automatic renewal — important disclosure

Your Floor Pass subscription will automatically renew each month at $5.00 USD until you cancel. By starting a subscription, you authorize us (through Stripe) to charge your payment method on file at the start of each billing cycle for the then-current subscription fee. This authorization continues until you cancel.

You will receive an email reminder before your free trial ends and a receipt after each successful renewal. You can review and cancel your subscription at any time from your account page (see Section 9.4).

9.4 Cancellation

You may cancel your Floor Pass subscription at any time, for any reason, by clicking "Manage subscription" on your account page. This opens Stripe's secure Customer Portal where you can cancel with one click. Cancellation takes effect at the end of your current billing period — you retain Floor Pass access through the end of the month you've already paid for, then your account reverts to the free tier. We do not require you to call, email, or speak to anyone to cancel.

9.5 Refund policy

Subscription fees are generally non-refundable. Because the 7-day free trial lets you fully evaluate Floor Pass before any charge is made, we do not offer refunds for partial months or unused features after a charge is processed. You may always cancel to prevent future charges (see Section 9.4).

We will, at our sole discretion, consider refund requests in cases of clear billing error, duplicate charges, or technical failure that prevented you from receiving the service. Email billing@buyoffseason.com to request a refund review.

9.6 Price changes

We may change the Floor Pass subscription price in the future. If we do, we will notify you by email at least 30 days before the change takes effect, and the new price will only apply to billing cycles starting after that 30-day notice period. You may cancel at any time during the notice period to avoid the new price.

9.7 Service interruptions and credits

We make a good-faith effort to deliver Floor Pass features reliably, but cannot guarantee uninterrupted service. We are not liable for missed alerts due to email delivery failures, third-party outages (Amazon, Keepa, Stripe, Resend), or scheduled maintenance. If the Service is materially unavailable for more than 7 consecutive days, you may request a prorated credit by emailing the address above.

10. Charitable donations (Commercial Co-Venture disclosure)

Buy Off-Season operates a charitable giving program in connection with Floor Pass subscriptions. This section provides the disclosures required under various US state commercial co-venture / charitable solicitation laws.

10.1 The promise

10% of every Floor Pass subscription payment ($0.50 per $5.00/month subscription) is donated to a qualifying 501(c)(3) charity selected by Buy Off-Season. This donation occurs automatically each time your subscription is successfully billed.

10.2 Quarterly charity rotation

Our designated charity rotates each calendar quarter to fund a counter-cyclical seasonal need. The current rotation, subject to change with reasonable notice:

Spring (Apr–Jun): Share Our Strength d/b/a No Kid Hungry (EIN 52-1367538) — funds summer meal programs
Summer (Jul–Sep): Operation Warm Inc. (EIN 51-0421753) — provides new winter coats for children in need
Fall (Oct–Dec): Habitat for Humanity International Inc. (EIN 91-1914868) — affordable home construction
Winter (Jan–Mar): Direct Relief (EIN 95-1831116) — disaster preparedness and extreme-heat response

We may substitute a charity in any quarter if the designated organization loses its 501(c)(3) status, becomes the subject of regulatory action, or otherwise ceases to meet our selection criteria. Substitutions will be posted on our giving page with at least 14 days' notice when practicable.

10.3 How donations are made

Donations are processed through Every.org (Every.org Inc., a 501(c)(3) donation-infrastructure non-profit). Every.org transmits funds to the designated charity and issues tax receipts to Buy Off-Season for our business records. As a Floor Pass subscriber, your subscription payment is not a tax-deductible donation — it is a payment for service. Buy Off-Season makes the charitable donation as part of its normal operating expenses.

10.4 Transparency and reporting

We publish a running total of donations made under this program on buyoffseason.com/giving, updated automatically each time a donation is processed. We publish quarterly summaries (total donated, charity receipts, any substitutions) on the same page.

10.5 No reduction in service

Your Floor Pass features and price are not affected by this donation program. The 10% donation comes from our gross subscription revenue — not from your $5 in addition to your $5.

10.6 State-specific notices

Where required by state law (including California, New York, Massachusetts, and others), we will register as a commercial co-venturer with the appropriate state authority before promoting this program to residents of those states. A copy of our current registration and contracts with each charity is available on request at the email below.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TIMELINESS, OR NON-INFRINGEMENT.

We do not warrant that:

The Service will be uninterrupted, timely, secure, or error-free
The information displayed will be accurate, complete, or current
Any defects in the Service will be corrected
The Service or the servers that make it available are free of viruses or other harmful components

Your use of the Service is at your own risk.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BUY OFF-SEASON AND ITS OPERATORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

Your access to or use of, or inability to access or use, the Service
Any conduct or content of any third party on the Service or on Amazon
Any content obtained from the Service, including editorial picks or field notes
Pricing inaccuracies or product availability discrepancies
Unauthorized access to or alteration of your transmissions or data

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed one hundred dollars ($100 USD).

13. Indemnification

You agree to indemnify, defend, and hold harmless Buy Off-Season and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party right.

14. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service — including specific features, picks, categories, or account functionality — at any time and without prior notice. We will not be liable to you or to any third party for any such modification, suspension, or discontinuation.

15. Changes to these Terms

We may revise these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent version. For material changes, we will provide notice on the site for at least 30 days before the changes take effect.

Your continued use of the Service after any changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the changes, you should stop using the Service.

16. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, for any conduct that we believe violates these Terms or is harmful to other users, to us, or to third parties, or for any other reason in our sole discretion.

17. Governing law and jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law principles.

Any dispute arising out of or related to these Terms or the Service shall be resolved in the state or federal courts located in Philadelphia, Pennsylvania, and you consent to the personal jurisdiction of such courts.

18. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

19. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Buy Off-Season regarding the Service and supersede any prior agreements.
